2017 Updates on Estate Recovery, ABLE Act and SNTs: what estate planners need to know
Speaker
Patricia Tobin
- New State Law can eliminate Estate Recovery on homes held in Revocable Trusts
- New Federal law allows competent beneficiaries to set up their own Special Needs Trust, without the need to have a parent, guardian, grandparent or court establish the Trust
- The Able Act allows disabled persons who were disabled prior to age 26, to create a state sponsored account, like a 529 account, which is not counted by SSI or Medi-Cal and can be funded with up to $14,000/year for qualified disability needs—like a “Special Needs Trust—LIGHT”
