The Tale that Wags the Dog: Finding Your Most Persuasive Trial Story

Every trial lawyer knows that to achieve the result your client wants in
mediation, settlement, arbitration, or trial, you need a good trial story. In this
CLE presentation, Sarah Murray will teach you a simple but powerful method
for analyzing a case to start building a persuasive litigation story. She will
then discuss when and why to test your story in litigation research or to seek help from a consultant who can help you shape your story, and gives some examples of how testing preliminary stories in research changed attorneys’ perspectives on their case and helped create a better outcome.
Learning objectives:
• Understand what makes for a persuasive litigation story
• Learn to apply the “four Cs” method to analyze plaintiff’s case and building a
persuasive defense story
• Understand when and why to use research to test your story or to bring in a consultant to help solve complex story challenges

Sarah Murray

President and CEO, Trialcraft

Sarah Murray is an anthropologist, writer, teacher, and performance coach who has been working as a trial consultant since 1999.

She founded Trialcraft in 2012 to serve her clients in new ways, and oversees a team of 10 consultants and research assistants who provide litigation research. She assists clients in pre-trial, trial, and post-trial work; and coaches trial attorneys to reach the highest levels of trial performance.

Sarah now focuses primarily on high-stakes, complex cases often featuring emotionally charged situations or parties who face high levels of bias. These include criminal and civil antitrust; sex crimes and murder cases; patent and intellectual property; contract and complex commercial cases; insurance coverage disputes; employment defense; class actions; medical malpractice defense; and asbestos defense.
