Pension Division Malpractice and QDROs

Retirement benefits are often the major asset in most divorce cases. There are approximately one million divorces per year and yet only about 40 pension division experts to assist family law attorneys and judges. A new web based platform enables a paradigm change and empowers family law attorneys with added ability to best represent their clients and meet the duty of competence.

From this ethics talk, participants will understand the family law attorney’s duty of competence regarding retirement benefit division in divorce which requires (1) understanding and use of technology and (2) not to commit malpractice.

In addition to their existing respective businesses, QDRO Experts Louise Nixon and John Madden have developed with other QDRO and Valuation Experts a new web-based platform called QDROCounsel (qdrocounsel.com). QC is a divorce and pension division strategy company that provides divorce professionals and judges with the assistance and case management tools needed to handle pension division from discovery to judgment on a case by case basis. Louise and John’s presentation will entail techniques and ways to ensure compliance with the proper standard of legal care through the use of technology.
