What’s New in Employment Law Other Than The 'Gig' Economy Rules--A Lot! Year 2019 in Review and Highlights for 2020

While the Dynamex decision restricting the use of independent contractors took top billing this year, there were other significant cases that active employment law practitioners and in-house representatives need to consider.

Kelly Savage Day will speak about the notable employment cases and laws that practitioners need-to-know; and Nancy McCarthy will carve out and outline the significant disability discrimination cases decided in 2019, including the ever changing “accommodation” rules.

Stay up-to-date. This presentation will highlight the key changes that took place in the last quarter of 2019 and the most significant labor and employment laws that went into effect on January 1, 2020.

Fortune 500 and small business clients, as well as state and local entities, rely on me for my industry knowledge, aggressive advocacy and practical advice. I have served as national, regional and local counsel for a variety of businesses, who depend on my ability to handle complex commercial litigation in state and federal courts, at both the trial and appellate levels in a cost-effective, results-oriented manner.

As the first college-educated member of my family and the daughter of two small-business owners, I appreciate the challenges companies face remaining competitive in a rapidly changing business environment without running afoul of state and federal laws and regulations. I focus on helping clients solve their problems based on their goals defined at the outset of a matter—not meeting some billable-hour requirement comprised of unnecessary tasks billed out in six-minute increments. I pride myself on efficiency—and my staunch commitment to delivering top-notch services and results on complex commercial litigation matters at a fair, reasonable price. My end goal is making you a client for life.

Clients describe me as a “brilliant strategist,” “excellent communicator,” “cracker jack” and a “value for the money.” In the trial court arena, I have achieved early dismissal at the pleading stage over 75% of the time. I also have never had a class certified against any of my clients. I am currently 6-0. In the appellate arena, I have won 80% of my appeals (including the ones that have made their way to the U.S. Supreme Court). Most recently, I first chaired a nearly two-month-long harassment case brought against California’s Department of Parks and Recreation concerning allegations of sexual discrimination and harassment based on an employee’s sexual orientation, which resulted in an extremely favorable outcome for my client.

Nancy P. McCarthy

Nancy focuses her practice on litigation matters, representing both plaintiffs and defendants. She has extensive experience in employment litigation and also in the representation of physicians, and clients in the pharmaceutical business and pharmacy practice. Nancy’s employment background includes litigating claims of discrimination, retaliation, wrongful termination, harassment and Unfair Labor Practices; including the representation of public employees before various Commissions and Administrative Law Judges. She also counsels clients on employee separations, severance agreements, classifications of employees, investigations of sexual harassment complaints, leave and accommodation issues, and traditional labor law negotiations and contracts.

Nancy has represented clients before the National Labor Relations Board, the Department of Fair Employment and Housing, the Equal Opportunity Commission, the Workers Compensation Appeals Board, the Employment Development Department, and the California Labor Commissioner, and The Medical Board of California, among others. She has appeared before the U.S. Courts of Appeals for both the 9th and 5th Circuits as well as numerous U.S. District Courts in both California and Louisiana. Nancy graduated from Cornell’s School of Industrial & Labor Relations, and as a Moot Court Scholar from Tulane University School of Law where she studied Comparative Law and Maritime Law, and was one of the founding editors of the Tulane Maritime Journal.
