Businesses large and small are confronting a wide range of financial losses and legal claims related to the COVID-19 pandemic, some of which threaten the companies’ very survival.
Insurance Coverage & Recovery Attorney Don A. Lesser of The Lesser Law Group, with offices in San Rafael, San Francisco and Sacramento, will lead a discussion of how the insurance policies businesses typically carry may provide protection for COVID-19 related losses, the defenses carriers are raising to deny or limit coverage, and how policyholders can try to overcome them. Shelter-in-Place orders have already caused widespread economic damage, and businesses are asking what protection their insurance policies provide, including:
• Will the business interruption coverage of commercial property policies cover business income losses caused by shutdowns or slowdowns? How are the insurers resisting these claims and how can policyholders argue for coverage?
• What about Civil Authority coverage?
• Are liability policies going to protect the company against lawsuits by customers, visitors, employees and others?
• How will Directors’ & Officers’ Liability policies respond to claims by shareholders, consumers, regulators and others alleging misleading public statements, unfair business practices, compliance failures, or the board’s failure to take appropriate steps to protect the corporation against loss resulting from the pandemic?
