Unique Challenges and Opportunities of Virtual Mediations: Tips and Best Practices From the Trenches

As virtual mediations become the current norm, our panelists will address the differences in preparing for and conducting mediations remotely. While the program is geared to attorney advocates, it will also be helpful to mediators. You will learn how to more effectively prepare your client and yourself for a successful virtual process. The panel of experienced neutrals will also share the hiccups and glitches they have experienced in remote sessions, and will invite participants to share their own stories. Finally, the panel will shed light on what differences can be anticipated when in person mediations begin. A short questionnaire about your experience with virtual mediations will be sent to registrants before the program.

Susan Feder

2020 MCBA President, Judicate West, Susan Feder Mediation

Susan has been a full-time mediator since 2010, and is on the panel of Judicate West statewide. She uses insight and intuition to bring a fresh and creative approach to reaching settlement. Before becoming a mediator, Susan was a business litigator with a national law firm and practiced in house as litigation counsel for Bank of America. Susan’s mediation practice covers a wide variety of cases, including tort, employment, real estate matters and commercial litigation. When negotiating a settlement, Susan focuses on uncovering the issues fueling the dispute, and redirecting the parties towards resolution and finality. Susan is the MCBA President for 2020.

Hon. Lynn O’Malley Taylor (Ret.)

JAMS Mediator and Arbitrator

Hon. Lynn O’Malley Taylor (Ret.) is with JAMS as a full-time neutral, bringing over 35 years’ experience as a trial court judge. In 1982, Judge Taylor was the first woman elected to the court in Marin County. She has served three times as presiding judge. In addition, Judge Taylor has served in Contra Costa, Sonoma, Monterey, Napa, Sacramento, and Orange counties and for the last seven years in the San Francisco Superior Court as part of the Judicial Council’s Assigned Judges Program.

Stephen Sulmeyer, J.D., Ph.D

JAMS Mediator and Arbitrator

Stephen Sulmeyer, J.D., Ph.D is a lawyer, clinical psychologist, mediator and collaborative coach in the Bay Area. He does his dispute resolution work exclusively through JAMS, and he maintains his psychotherapy practice in Marin County. He received his undergraduate and law degrees from Stanford University, and his doctorate in psychology from the Institute of Transpersonal Psychology in Palo Alto, California, where he has taught as a member of the adjunct faculty.
