Conducting Effective Workplace Investigations in Today’s Workplace

Diana Maier and Emily Harrington, employment attorneys and investigators at Maier Law Group, will speak regarding current industry best-practices for workplace investigations. They will cover: the hallmarks of a strong investigation versus a weak one; whether an internal or external investigator is best-suited to conduct the investigation; and how a well-conducted investigation supports an employer’s defense in litigation and saves an employer money in the long-term. Diana and Emily will also discuss current trends in workplace investigations, such as implicit bias allegations, diversity equity and inclusion (“DEI”)’s impact on allegations, and how remote work has affected employee allegations.

***For those that are not able to attend but interested in the post-meeting recording, we require that you Register for the Event. Once the presentation is over, if the recording is adequate, we will send it to those that were not able to attend. If the recording is distorted and can not be viewed, MCBA will refund your registration fee. MCBA does not provide CLE for viewing recordings post presentation.***

Diana Maier

Maier Law Group

Diana Maier is the founder of Maier Law Group, a bay area boutique, all-female employment law firm. Diana is a skilled mediator and a recognized expert in employment law, investigations (which she conducts in both Spanish and English), and executive coaching and training. Diana’s investigation practice includes both workplace and educational institution (Title IX) investigations. She holds a certificate from the Association of Workplace Investigators (AWI-CH), meaning that Diana has completed AWI’s comprehensive training in workplace investigations and passed an oral and written test that AWI administers at the end of its course.

Diana has received mediation training from The Center for Understanding In Conflict, and was also trained by, and serves as an empaneled mediator for, The Northern District Court of California. In addition, she mediates privately and as a member of the Contra Costa County Superior Court, the San Mateo County Bar Association, the County of Alameda Day of Court Program, the Central District Court of California, and the Riverside Superior Court.
In 2022, Diana was named as a Northern California “Super Lawyer,” for employment law and mediation, an honor reserved for only 5% of attorneys in Northern California who exhibit excellence in practice.

Emily Harrington

Maier Law Group

Emily Harrington is an associate at Maier Law Group, a Bay Area boutique, all-female employment law firm. Emily joined the firm in July 2022. Emily’s practice focuses on employment advice and counsel and workplace investigations. Emily advises employers on all aspects of California and federal employment law.

Emily attended U.C. Berkeley as an undergraduate and Duke Law School, where she was the Editor-in-Chief of the Duke Law & Technology Review and served on Duke Law’s Wrongful Convictions Clinic. Emily started her legal career as a litigation associate at Cooley LLP’s Palo Alto office, where she worked on a wide variety of complex commercial litigation matters. Before joining Maier Law Group, Emily worked in-house at a non-profit organization where she counseled the agency on employment and compliance matters and oversaw the Human Resources functions of the organization.

At Maier Law Group, Emily enjoys providing practical, business-minded advice in her employment counseling practice. She also enjoys conducting workplace investigations, which allows her to draw on her natural empathy for all sides and provide the participants the dignity and respect that enables them to feel heard. Emily recently completed the Association of Workplace Investigators (AWI) Training Institute where she was comprehensively trained on conducting workplace investigations. Emily is an AWI Certificate Holder (AWI-CH).
