Please join the MCBA Family Law Section for a virtual presentation, Meeting with the Family Law Bench--A "How-To" on Effectively Presenting, and Defending, Requests for Domestic Violence Restraining Orders (from Filing to Hearing) with the Marin County Superior Court Family Law Judges and Commissioner; moderated by Marie Barnes, Attorney at Law, and Virginia Millacci, Family and Children's Law Center.

Learn about what our Family Law Judges and Commissioner would like to see (and not see!) from the Bar when it comes to requesting, and defending, Domestic Violence Restraining Orders, including how to prepare effective pleadings and how best to present evidence and testimony at trial. This will be a question-and-answer session, likely with time for questions from the audience at the end.

Family & Children's Law Center

Virginia Dalton Millacci, Esq. (pronouns: they/them) is the Executive Director of Family & Children's Law Center ("FACLC"), the only legal aid non-profit in Northern California providing low-income Marin families legal assistance and direct representation on general family law matters, domestic violence retraining orders, and Special Immigrant Juvenile Status predicate orders. By providing services that span all areas of family law, FACLC carries out its vision of: (1) preventing domestic violence; (2) advocating for the rights of children; and (3) supporting families’ well-being and financial security for low-income Marin County residents. Since 2019, Virginia has worked with FACLC assisting and representing survivors of domestic violence to obtain restraining orders. Additionally, as a trained Domestic Violence Advocate, Virginia works closely with other Marin community non-profits to provide safety planning workshops for survivors of domestic violence.

Marie A. Barnes

Attorney at Law

Marie A. Barnes devotes herself to the practice of Criminal Defense and Family Law. Marie is a litigator who enjoys being in the courtroom. In the area of criminal defense, she has handled juvenile matters, Misdemeanors, and Felonies throughout the bay area. She serves as a panelist on the Misdemeanor panel for the Marin County Alternate defender.

Her experience in the courtroom began as a certified law clerk with the Alameda County District Attorney’s office where she gained valuable experience in motion practice and Felony evidentiary hearings. She began practicing family law after defending restrained parties in Domestic Violence Restraining Order proceedings. Marie’s family law practice has focused on issues of domestic violence and the effects either on divorce proceedings or custody matters. She has extensively worked both prosecuting and defending against domestic violence restraining orders.

Marie was born in San Francisco and is fluent in Spanish. She received her bachelor’s degree from Sonoma State University in Political Science and Psychology and received her Juris Doctorate from Western Michigan University, Thomas Cooley Law School. She is a Marin County Bar Past Director, Past President of the Richard Sangster Inns of Court and currently the co-President of the Association of Latino Marin Attorney’s (ALMA).
