Certified Specialist in Legal Malpractice Law for this ethics-focused presentation which will address two of the most challenging areas of legal practice: the ethical duty to disclose an error to a client; and the proper procedure for withdrawing from representation. Attorneys will leave with practical strategies to navigate these difficult scenarios while protecting client interests and complying with their ethical obligations.

Attorneys may occasionally find themselves in situations where a misstep has occurred or where continuing representation is no longer tenable. Understanding when disclosure is mandatory, how to communicate effectively and ethically with the client, and how to withdraw in compliance with the California Rules of Professional Conduct is critical to maintaining professional integrity—and minimizing risk.

Lawyers’ Mutual Insurance Company

Anne Thompson is the Chief Claims Officer for Lawyers’ Mutual Insurance Company. Lawyers’ Mutual Insurance Company has been providing professional liability insurance to California lawyers since 1978. The company primarily insures sole practitioners and lawyers in small firms, as well as bar associations throughout California. In the 1970s, legal malpractice claims of all types were escalating. As a result, legal malpractice insurance premiums were increasing rapidly, making liability insurance too expensive for many sole practitioners and attorneys in small firms. Lawyers’ Mutual was established under the auspices of the State Bar of California, to help make affordable and consistently available legal malpractice insurance for such lawyers.

Ms. Thompson leads the claims department overseeing litigation and pre-litigation strategy and legal analysis of duty, breach, causation and damages in defense of claims. She is also responsible for the evaluation of coverage concerns regarding policyholder tenders. She participates in mediation and settlement negotiations on behalf of policyholders. Ms. Thompson provides hotline assistance with ethical issues or concerns from policyholders.

She previously acted for Lawyers’ Mutual as director of content and production of live MCLE available to policyholders. For 10 years prior to being promoted to Chief Claims Officer, Ms. Thompson held the title of Claims Attorney.
