The Neuropsychological Approach to Capacity: A Deep Dive
A determination of cognitive capacity IS at the heart of elder law.
Estate Planning and Probate lawyers are as likely to identify a cognitively disordered individual as is the individual’s primary care physician and be in a position to refer who gets treated or protected and identify those who might be vulnerable to exploitation and abuse.
Increasingly attorneys are going to be asked to support their assessment of these matters and be held responsible and accountable for the determinations and their impact. Dr. Canick will discuss the array of cognitive tests and explore misconceptions.
