Section Probate and Estate Planning


The Probate and Estate Planning Section covers substantive and procedural law governing trustees, probate estates, guardianships, conservatorship and other matters affecting trusts and estates and administration. The section offers Continuing Legal Education (CLE) and works closely with the bench to improve the administration of justice in the Probate Court.

Most of us have relied on a spouse’s signed, delivered, and recorded quitclaim deed to conclude that the real estate is separate property. That is not necessarily so under the California Appellate Court’s recent decision in Estate of Wall (2021) 68 Cal.App.5th 168. The surprising decision is important to estate attorneys, as well as family and real property attorneys dealing with real estate titles involving married people.

Effective April 13, 2022, eDelivery, a service that will allow for the electronic submission of filing documents for Civil, Family, Probate, and Small Claims will be available on the Court’s website at http://www.marincourt.org/edelivery.htm. eDelivery is not mandatory, and also does not replace the Court’s future goal of implementing eFiling. The Court is in the process of updating its case management system which is a requirement for implementing eFiling. Please see Local Rule 1.51 and Emergency Local Rule 22.01 which govern the use of eDelivery.

A Celebration of Life honoring the Honorable Richard H. Breiner will be held on Friday, May 27, 2022 at 1:30 p.m. at the Marin Veterans’ Memorial Auditorium at the Marin County Civic Center. We all lost a simply remarkable and iconic leader, lawyer, and judge when Richard H. Breiner died on February 26, 2022, at his home in San Rafael. He was 87 years old.
