The October MCBA ADR Section Meeting presentation, The Art of Bracketing, will be held both in person and virtually (hybrid) on Thursday, October 19th in the Assembly Room at the Marin County Sheriff's Office or you can participate via a Zoom Webinar.

The term “brackets” raises anxiety or ire for many mediators and attorneys because it is susceptible to so many different interpretations. (And, of course, there is the math!) This often leads to a knee-jerk resistance to the use of this powerful negotiation technique. This presentation will cover various forms of “bracketing” such as conditional offers, public and private ranges, specific numbers, etc., as well as the many ways brackets can facilitate resolution. We will discuss common assumptions made, benefits and drawbacks of different bracketing methods, timing considerations, and best practices for avoiding bracketing pitfalls and ethical dilemmas. Bracketing in its many forms can add another sophisticated and flexible negotiating instrument to the mediator’s toolbox. Bring your questions and join the conversation.

Kari Erickson Levine founded Erickson Levine Law in 2015 with a passion for finding creative solutions to even the most complex and highly charged disputes. She has handled 70+ matters and is an empaneled mediator for the Northern District of California. After graduating from UC Hastings School of law in 1989, Kari worked as an assistant DA in Compton, CA. Diana L. Maier

Maier Law Group

Diana is a mediator, workplace and Title IX investigator, and employment attorney. She is the founder of Maier Law Group, a boutique employment defense law firm. These days Diana spends most of her time mediating privately as well as a panelist for the Central and Northern District Courts of California. She also mediates all kinds of interpersonal conflicts, especially between employees, business partners, family members disputing estate plans, etc.

Diana's other key specialty is performing workplace investigations in Spanish and English. In terms of counseling work, Diana advises business owners on issues that arise in the workplace, and defends employers facing litigation. Diana has been named a Northern California "Super Lawyer" for ADR services for the last few years.
