Barbara Monty and Sarah Burke will lead a discussion focused on complications that arise during the mediation of construction matters. A few topics that will be discussed at the program include:
1. Resolving the “mixed” case, a contractor has a claim for non-payment and the homeowner a competing claim for defects. How do you juggle the needs of the homeowner, contractor and insurance company to reach a resolution?
2. What is the effect of a pending CSLB complaint on your construction defect suit? How can the pending complaint affect coverage issues, parties’ attitudes and willingness to compromise? What is the procedural interplay between the CSLB matter and the defect suit?
